The rules that keep Tenderkind safe for the people it’s built for.

1. Acceptance of terms

By creating an account, browsing the site, or interacting with any creator whose work is hosted on Tenderkind, you agree to these Terms of Service and to our Privacy Policy. If you don’t agree, please don’t use the service. We may update these terms as the product evolves; the version that matters is the one posted on this page on the day you used the service.

2. Platform use

Tenderkind is built for adults. By using the platform you confirm that you are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and that you are legally allowed to view adult content where you live. One account per person — no shared logins, no resale of access, no bots or scrapers, and no pretending to be someone you’re not. Keep your profile information accurate and keep your credentials to yourself.

Acceptable use means no minors in any form (real, depicted, simulated, or implied), no non-consensual content, no illegal material, no harassment, no doxxing, and no spam. Prohibited technology includes credential sharing, scraping the platform or its creator feeds, automated account creation, and reselling or sublicensing access to Tenderkind. Breaking these rules can mean suspension or permanent removal, with or without warning.

3. Creator content policy

Creators keep ownership of everything they upload. By posting, you give Tenderkind a limited, non-exclusive licence to host, store, deliver, and display that content to your subscribers and to the audiences you’ve chosen to make it visible to. That licence ends when you delete the content or your account, except for copies held in routine backups for up to thirty days.

Zero tolerance for any depiction of minors — real, fictional, drawn, AI-generated, or implied. We cooperate with lawful requests from law enforcement and report suspected child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and other relevant authorities. We require 2257-compliant age verification and performer documentation for every creator before a paid post can go live.

DMCA takedowns: send a complete notice (your contact info, identification of the copyrighted work, identification of the allegedly infringing material on Tenderkind, a good-faith statement, a statement under penalty of perjury, and your physical or electronic signature) to tenderkind@polsia.app. We forward counter-notices under the procedure laid out in 17 U.S.C. § 512(g). Content may also be removed preemptively to comply with applicable law, payment-processor rules, or platform safety standards.

4. Payment terms

Subscriptions and one-time purchases are processed by Stripe on behalf of Tenderkind. Prices are shown in U.S. dollars and may be quoted in other currencies for display only; your card is charged in the currency Stripe presents at checkout. By buying a subscription you authorise recurring charges until you cancel.

Refunds are handled case by case. We refund subscription charges within fourteen (14) days when the underlying content was not delivered for a technical reason on our side, and we refund unauthorised charges. Tips are non-refundable once processed. Platform fees and the creator split are listed per creator on their /c/[username] page; Tenderkind’s standard split puts the creator ahead of the platform from the first paid subscriber.

Creators on Tenderkind are independent contractors, not employees, agents, or joint venturers of Tenderkind. You are responsible for reporting and remitting any taxes owed in your jurisdiction on earnings from the platform. U.S. creators who meet the federal 1099 reporting threshold will receive an annual statement via the email on file; non-U.S. creators receive equivalent documentation where their local rules require it.

5. Account termination

We may suspend or terminate any account that breaches these Terms, that is the subject of a lawful takedown or law-enforcement request, or that triggers a chargeback pattern we can’t reconcile in good faith. You may delete your account at any time from Settings → Account; doing so cancels future charges, revokes active sessions, and triggers deletion of your content and personal data within thirty (30) days, except for records we’re required to keep (tax, financial, and safety-incident logs).

On termination, outstanding payouts to creators settle on the regular payout schedule (or sooner, at our discretion) and any pending refunds or chargebacks are netted out first. Subscription revenue earned before termination is paid out under the standard split; revenue earned through fraud or rule-breaking is forfeit.

6. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. The company entity behind Tenderkind is the Delaware C-corp referenced in our official correspondence at tenderkind@polsia.app. Venue for any dispute that isn’t subject to the arbitration clause below lies exclusively in the state and federal courts located in San Francisco County, California.

For users in the United States: you and Tenderkind agree to resolve any dispute through individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and you waive the right to participate in a class, collective, or representative action. For users outside the United States: nothing in this section overrides the mandatory consumer-protection laws of your home jurisdiction, and disputes are heard by a court of competent jurisdiction there.
